PROCEDURES AND TERMS & CONDITIONS GOVERNING SEASON PARKING
CONTRACTS FOR SEASON PARKING SHALL BE GOVERNED BY THE TERMS AND CONDITIONS CONTAINED HEREIN
  1. Application
    1. This application is only applicable for parking at One Raffles Place (the “Carpark”).
    2. Subject to the terms and conditions herein, OUB Centre Limited (hereinafter referred to as “Owner”) hereby grants the season parker (“Season Parker”) and the Season Parker hereby accept a licence to park the motor vehicle(s) / motorcycle(s) in the parking lots at the Carpark.
    3. Subject to the terms and conditions herein, the Season Parker shall not transfer all or any rights under this Terms & Conditions to any other person.
    4. Applications for season parking are to be made through this online Car Park Portal. All fields marked with an asterisk (*) are mandatory, especially the email address which we will use as the main point of communication with you.
    5. By submitting an application through the online Car Park Portal, the Season Parker shall be deemed to have:
      1. i. declared that the particulars and information given are true and accurate;
      2. ii. consented to the collection, use and disclosure of his/her personal data by the Owner in connection with the car park services including incidental purposes as may be appropriate; and
      3. iii. read, understood and agreed to be bound by the terms and conditions set-out herein.
    6. The Season Parker shall, in a timely manner, update his particulars should there be any changes, via the online Car Park Portal.
    7. The Season Parker may be required to furnish further information if the submitted application is incomplete, or if required to by the Owner. Failing which, the application will be rejected.
    8. We wish to inform you that we collect and use the personal data of applicants for the purpose of identification (including distinguishing between applicants with similar or same names), administration, and to facilitate contact and communication in connection with operational and legal matters.
    9. The Season Parker can apply for up to a maximum of 3 months of season parking in each application. Season parking is not renewed automatically unless renewal intention & payment is made before the commencement of the following month.
    10. Any approval of applications shall be for entire calendar months. Season parking will not be allocated or apportioned on a part thereof month basis.
    11. The Owner reserves the right to reject any application or withdraw any approval at its discretion.
  1. Charges and Payment
    1. The Season Parker will be directed to make payment of season parking fees based on the permitted payment methods indicated on the Car Park Portal, such as when applicants have been allocated or are renewing a season parking lot.
    2. Payment methods available and conditions of use:

      1. Visa and MasterCard debit/credit cards

      By selecting payment via debit/credit card, you authorize the Owner to collect such amounts by charging the Season Parker’s credit card / debiting the Season Parker’s account (details of which are to be provided by the Season Parker).

      If the Season Parker is directed to the website of our third party payment processor, the Season Parker may be subjected to terms and conditions governing the use of that third party’s service and personal information collection practices. We shall not be responsible for any loss or harm to the Season Parker resulting from the Season Parker’s use of that third party’s service.

      The Season Parker shall be responsible for any fees that may be charged to the Season Parker by the Season Parker’s bank in relation to the payments.

      All payments shall be made in Singapore Dollars.

    3. For renewals, payment must be received on or before the 26th of the preceding month in the online Car Park Portal to confirm the acceptance of the car park lot allocated for the month. Upon clearance of payment, a valid Tax invoice can be downloaded from the online Car Park Portal. If payment is not received by then, the season parking contract shall be deemed to be terminated with effect from the first day of the month for which the fee is not paid.
    4. Season parking fee (the "Monthly Fee") shall be paid for a FULL month.
    5. The rates of season parking fees may be revised from time to time by the Owner at its absolute discretion. Accordingly, where car park fees have been paid in advance, season parking holders shall be liable upon notice to effect top-up payments in accordance with the terms of such notice; subject however, that increases in car park fees shall not apply for existing car park holders in respect of (a) the month in which holders are notified of such revision or such revision is published in the online Car Park Portal, and (b) the following month.
  1. Change of Vehicle
    1. Season parking fee paid for one vehicle will be valid for the designated vehicle IU and vehicle registration number as submitted by the Season Parker in the online Carpark Portal, and upon the full payment of the Monthly Fee.
    2. Any reassignment of the season parking rights shall be at the sole discretion of the Season Parker and may be assigned under the follow circumstances:
      1. the purchase/lease of a new vehicle,
      2. if the designated vehicle is under repair and a replacement vehicle is used.
    3. Any request for temporary change of vehicle IU number can be made online via the “Change of Vehicle & IU” module up to a maximum of three times a year.
  1. Cancellation, termination and refund
    1. There shall be no refund for any unused period within a month under any circumstances.
    2. Any refund of the Monthly Fee paid for full unused month(s) of the season parking will be made via cheque, sent to the season holder.
    3. The Season Parker may cancel/terminate their season parking usage via the online Car Park Portal.
    4. Once the season parking is cancelled/terminated, the parking lot will be released for application.
    5. The Season Parker will have to continue paying for the lot in order to maintain their season parking allocation. Suspension of season parking is not permitted.
    6. Offset of season parking fees from one month to another will not be allowed.
    7. Late renewal of season parking shall not entitle the season parking holder to a refund of any hourly parking fee paid.
    8. Refund of hourly parking fees charged due to wrong IU number submitted shall not be permitted.
    9. The Owner may at its sole discretion terminate an existing season parking contract:
      1. by giving at least one (1) month's written notice to the season parking holder (such notice may be sent by email), such termination to take effect from the date stated in a notice of termination. In such an event, car park fees already paid would be refunded on a pro-rata basis in respect of any remaining period; or
      2. immediately upon notice if any season parking holder is found to have contravened the car park Usage terms (stated in Clause 5 below) or is otherwise in breach of these Terms and Conditions. In such an event, the season parking fee paid for any unused period of the current month will not be refunded.
  1. Usage
    1. The Season Parker shall:
      1. take all due care and attention, and drive safely, whilst in the car park;
      2. strictly conform to and abide with all rules and regulations which may be issued by the Owner from time to time, and with instructions and directions given by its authorized staff, as well as with any authorized notices, signs or markings displayed or affixed in the car park unless otherwise instructed;
      3. not damage the car park (including equipment), bring any hazardous or combustible material into the car park, park their vehicle in unauthorised places, or engage in illegal, offensive or immoral activities within the car park;
      4. not resell their season parking lot; and
    2. The Owner shall have the right to retain (by wheel-clamping or otherwise) vehicles as security for monies due and owing. Vehicles which are improperly parked or parked outside of designated areas, or which have caused damage to the car park or its equipment, may be wheel-clamped, and a fee of $214, or such other amount as may be prevailing from time to time, shall be payable for the release of the wheel-clamp. The Season Parker consents to the foregoing actions for himself as well as on behalf of the vehicle owner.
  1. Disclaimer of liability
    • The Owner and its employees shall not be liable for, and the Season Parker shall not claim against the same, in respect of any theft, loss or damage or cost or expense, of any nature, howsoever caused or incurred, whether due to or arising from their negligence, want of care, acts, omissions or default or otherwise, to or of any vehicle or the fittings or contents of any vehicle moving in and out of or parked in the car park or other personal property. Every vehicle whilst in the car park is parked entirely at Season Parker’s risk. Where the vehicle used by the Season Parker is not owned by him/her, the owner of the vehicle shall: (a) be informed by the Season Parker of the terms of this disclaimer, and (b) by permitting the Season Parker to park the vehicle at the car park, be deemed to have agreed to be bound by the terms of this disclaimer.
  1. Others
    1. The terms and conditions herein may be revised, deleted or new conditions added, by the Owner, without prior notice.
    2. These terms and conditions shall apply together with the terms contained in any notices which may be displayed at the car park, save that in the event of any inconsistency with those terms, these terms and conditions shall prevail to the extent of such inconsistency.
    3. In respect of season parking contracts entered into prior to this online Cark Park Portal becoming operational 01 January 2019 the terms and conditions herein shall constitute a revised set of terms and conditions and shall accordingly supersede previous terms and conditions governing season parking contracts.
    4. The parties to the season parking contract (when entered into) would be the Season Parker and the Owner.
    5. A failure by the Owner to exercise or enforce any of its rights under this contract shall not constitute a waiver of any of the rights so as to bar the exercise or enforcement thereof at any subsequent time.
    6. Except as provided for elsewhere in these terms and conditions, all matters (including disputes) in connection with this contract and the use of the car park shall be kept strictly confidential.
    7. The season parking contract shall be governed by the laws of Singapore. The Season Parker agrees to submit to the exclusive jurisdiction of the Courts of Singapore.
    8. One Raffles Place website's Privacy Policy shall additionally apply to this online Car Park Portal.
